Common use of COMPENSATION TO THE ARCHITECT Clause in Contracts

COMPENSATION TO THE ARCHITECT. The DISTRICT shall compensate the ARCHITECT as follows: 1. ARCHITECT change orders fees are paid as approved by the District Board. If a change order is approved without ARCHITECT fee, no fee will be paid to the ARCHITECT unless negotiated before commencing change order work. 2. Payment to the ARCHITECT will be as set forth on Attachment “A”. 3. To the extent that the time initially established for the completion of ARCHITECT’s services is exceeded or extended through no fault of the ARCHITECT, compensation for any services rendered during the additional period of time shall be negotiated and subject to prior approval by DISTRICT Board. Assessment and collection of liquidated damages from the Contractor is a condition precedent to payment for extra services arising from Contractor caused delays. 4. Expenses incurred by the ARCHITECT and ARCHITECT’s employees and consultants in the interest of the PROJECT shall have prior DISTRICT written approval before they are incurred and records of such expenses shall be provided to DISTRICT for the DISTRICT’s review.
