Common use of Completion of Program Clause in Contracts

Completion of Program. a. By accepting tuition assistance, members agree to continue their employment by the district for three (3) years after completion of an approved plan of study. If a member leaves the district prior to completing an approved plan of study or prior to expiration of the three-year period after completion, an amount equal to the total amount of tuition assistance received by the member will be deducted from the member’s final payroll check. Upon approval of the Board of Education, the pay back will be prorated when extreme circumstances, such as critical illness or spousal relocation, necessitate the member leaving the district. Proration will be according to the number of years the member has worked beyond the completion of the approved plan of study. Such deduction shall not exceed the amount of the member’s final payroll check after deducting taxes and insurance. No such deduction will be made if the member’s employment is terminated or non-renewed by the District within three years after completion of an approved plan of study. b. If a member fails to complete an approved plan of study and continues to be employed by the district, an amount equal to the total amount of tuition assistance received by the member will be deducted from the member’s final payroll check of the fiscal year when the plan of study was dropped. Such deduction shall not exceed the amount of the member’s final payroll check after deducting taxes and insurance.
