Common use of Compliance with Express Negligence Rule Clause in Contracts

Compliance with Express Negligence Rule. The indemnification, waiver, and release provisions of Seller in this Agreement, including those in this Section 18 and Section 20 below, shall be applicable whether or not the Claims in question arose solely or in part from the active, passive, comparative, contributory, concurrent, sole or joint negligence, strict liability or other fault of any of the Buyer Parties, other than gross negligence and willful misconduct.
