COMPLIANCE WITH OTHER APPLICABLE LAWS. To the best of each Borrower’s knowledge, each Property and Improvements comply with all covenants and restrictions of record and applicable laws, ordinances, rules and regulations, including, without limitation, all laws, ordinances, rules and regulations relating to zoning, setback requirements and building codes. No Improvements constitute a nonconforming structure and the operation of the Facility is not a nonconforming use under current zoning, and there are no waivers of any current building code requirements for the Property or Improvements. The Facility is in compliance in all material respects with the Americans With Disabilities Act and regulations thereunder and the Federal Housing Act and regulations thereunder, each to the extent applicable. Each Borrower agrees to indemnify and hold Lender harmless from any fines or penalties assessed or any corrective costs incurred by Lender if any Improvements or any Property, or any part thereof, is hereafter determined to be in violation of any covenants or restrictions of record or any applicable laws, ordinances, rules or regulations, and such indemnity shall survive any foreclosure or deed in lieu of foreclosure.
