Compliance with service level specifications. (a) To the extent that the agreements referred to in sub-Clause (2) above (as modified, supplemented or replaced from time to time) involve the delegation of agreements referred to in sub-Clause (2) above (as modified, supplemented or replaced from time to time) to the extent that it cannot recover compensation in respect of that liability from the RSP’s obligations under this Agreement to a person who has agreed to perform them in accordance with a specified service level, the RSP will perform those obligations in accordance with that service level. (b) The RSP will not be liable for any breach of this Agreement to which a particular service level applies to the extent that its obligations under this Agreement are performed in accordance with that service level. (c) The RSP will not be liable for any breach of any of its obligations under this Agreement which have been delegated to another person or persons under the agreements referred to in sub-Clause (2) above (as modified, supplemented or replaced from time to time) to the extent that it cannot recover compensation in respect of that liability from such person (s) under those agreements. (d) the RSP will not be liable for any breach of any of its obligations under this Agreement which are caused by TTL failing to perform any of its obligations under its Clearance Agreement (as modified, supplemented or replaced from time to time). (e) To the extent that the agreements referred to in sub-Clause (2) above (as modified, supplemented or replaced from time to time) involve the delegation of the RSP’s obligations under this Agreement to a person who has agreed to perform them in accordance with a specified service level, and that service level provides for obligations to be performed by the Operators, the Operators will perform those obligations in accordance with that service level. The obligations to be performed by the Operators may, for example, require them to provide estimates of the extent to which they expect to use the RSP’s services in the future.
