Common use of Concurrent Delay Clause in Contracts

Concurrent Delay. If an Inexcusable Delay occurs concurrently with a Compensable Delay, either of which would have delayed Substantial Completion, the Design/Builder shall be entitled to an adjustment of time for the period that the delays are concurrent, but not to additional compensation on account of losses arising from the circumstances that caused the delay, including lost productivity, impact and inefficiency.
