Condemnation, etc. There is no existing, pending or, to Landlord’s knowledge, contemplated, threatened or anticipated (1) condemnation of any part of the Land, (2) repaving, widening, change of grade or limitation on use of streets, roads, or highways abutting, (3) change in the zoning classification of the Land, or (4) special tax or assessment to be levied against the Land due to capital improvements to be constructed on, near or adjacent to the Land.

Condemnation, etc. The Purchased Vessel shall be condemned or otherwise taken under color of law or requisitioned and the same shall continue unremedied for at least 20 days, unless such condemnation or other taking would not have a Material Adverse Effect.

Condemnation, etc. Any Governmental Authority shall condemn, nationalize, seize or otherwise expropriate any substantial portion of the assets of, or the Capital Securities of, any Obligor by means of a final and non-appealable resolution; or take any action that would prevent any Obligor from carrying on, or would have a material adverse effect on, the rights conferred on the Borrower under, or the material terms of, the Concession Title, including any action that would result in the Concession Title ceasing to grant the Borrower the rights originally provided therein or the Concession Title being terminated or the rights originally provided therein as exclusive to the Borrower becoming non-exclusive.

Condemnation, etc. Neither the Borrower, nor any of the Guarantors or Borrower’s Members has any knowledge of any condemnation, zoning or other land use regulation proceedings, either instituted or planned to be instituted, which would adversely affect the use or operation of the Facilities.

For purposes of this Section 7.8, "substantial portion" means assets (valued at the higher of book or fair market value) having a value in excess of 10% of the consolidated assets of the Company and its Subsidiaries.

Condemnation, etc. In the event that the Trust Estate or any part thereof shall be taken under the power of eminent domain or like power, then, unless the Beneficiary otherwise consents, all proceeds and avails thereof shall be applied by the Grantor to the prepayment of the Obligations (such prepayments to be applied in such order and manner as the Beneficiary may, in its sole discretion, elect).
