Common use of Condition of Membership Clause in Contracts

Condition of Membership. No person may become a Member of the Fund without first signing the Subscription Agreement; such person’s signature on the Subscription Agreement constitutes the Subscriber’s specific acceptance and adoption of each and every provision of this Agreement and such Subscriber’s counterpart signature page to this Agreement. Any act by the Fund to offer or provide Member status or reflect that status in the Fund’s records shall automatically include the condition set out in this paragraph.
