Common use of Condition of Title Clause in Contracts

Condition of Title. At Closing, Seller shall convey good and insurable fee simple title to the Property by limited warranty deed, subject only to those matters as shall be either expressly accepted or deemed accepted by Purchaser pursuant to the terms of this Article 7 (collectively, the “Permitted Title Exceptions”).

Condition of Title. At the Closing, Seller shall convey good and insurable fee simple title to the Property Land to Buyer by limited warranty deedthe Deed and other legal instruments and documents of conveyance. When title is conveyed to Buyer, subject only to those matters as such title shall be either expressly accepted or deemed accepted by Purchaser pursuant free and clear of all liens, encumbrances, easements, restrictions, rights, conditions and exceptions to title, except the terms of this Article 7 (collectively, the “Permitted Title Exceptions”)Exceptions thereto.

At Closing, Seller shall convey good and insurable fee simple title to Buyer by means of a Special Warranty Deed in recordable form conveying the Property to Buyer free and clear of all claims, liens and encumbrances created by limited warranty deedSeller or arising subsequent to Seller's acquisition of title, subject only to except those matters as shall be either expressly accepted or deemed accepted by Purchaser pursuant to the terms of this Article 7 (collectively, the “Permitted Title Exceptions”)Exceptions set forth in Paragraph 5b.

At Closing, Seller shall convey good good, marketable and insurable fee simple title to Purchaser by means of a Special Warranty Deed in recordable form conveying the Property by limited warranty deedto Purchaser free and clear of all claims, subject only to liens and encumbrances except for those matters as shall be either expressly accepted or deemed accepted by Purchaser pursuant to the terms of this Article 7 items (collectively, the “Permitted Title Exceptions”)) referred to in items 6, 7 and 8 of Schedule B of the Title Policy referred to in paragraph 3(b) hereof.

At Closing, Seller shall convey good and insurable fee simple title to the Property to Purchaser by limited statutory warranty deeddeed (the "Statutory Warranty Deed"), subject only to those matters as shall be either expressly accepted or deemed accepted by Purchaser pursuant to the terms of this Article 7 (collectively, the “Permitted Title Exceptions”).
