Common use of Conditional Completion Certificate Clause in Contracts

Conditional Completion Certificate. Notwithstanding the above it is clarified, that in the event that the Works have been substantially completed and in order to allow the Supplier to comply with schedule the IAA shall be entitled, at its sole discretion, to issue the Supplier a conditional Completion Certificate, detailing the defects and malfunctions of the System remaining to be solved and cured and any reservations and conditions for the Supplier to be granted with an unconditional Completion Certificate (the "Punch List Items" and "Conditional Completion Certificate", respectively). Upon issuance of a Conditional Completion Certificate, the Supplier may be granted, at the IAA’s sole discretion, the authorization to begin the OMP. An unconditional Final Acceptance Certificate shall be issued by the IAA only after the Supplier has cured all Punch List Items specified in the Conditional Completion Certificate within the dates specified by the IAA (the "Unconditional Completion Certificate"). Failure by the Supplier to rectify the Punch List Items on time will entitle the IAA to Liquidated Damages for Delay, as specified in section 9.139.9 above, mutatis mutandis. It is further clarified that the Unconditional Completion Certificate shall not be issued unless the Supplier satisfied all conditions specified in the Conditional Completion Certificate.
