CONDITIONS AND PROCEDURES. Anyone classified as a full time employee of the Okeechobee School Board who has been employed for a minimum of one (1) full year of creditable service immediately prior to application for membership and who has a minimum of four (4) days accrued sick leave shall be eligible for membership in the bank.
CONDITIONS AND PROCEDURES. 1. The Principal Representative may terminate the services of the Contractor, which termination shall take effect immediately upon service of Notice thereof on the Contractor and his or her Surety, whereupon the Surety shall have the right to take over and perform the Contract. If the Surety does not provide Notice to the Principal Representative of its intent to commence performance of the Contract within ten (10) days after delivery of the Notice of termination, the Principal Representative may take over the Work, take possession of and use all materials, tools, equipment and appliances on the premises and prosecute the Work to completion by such means as he or she shall deem best. If the Principal Representative takes over the Work and if the unpaid balance of the contract price exceeds the cost of completing the Work, including compensation for any damages or expenses incurred by the Principal Representative through the default of the Contractor, such excess shall be paid to the Contractor. If, however, the cost, expenses and damages as certified by the Architect/Engineer exceed such unpaid balance of the contract price, the Contractor and his or her Surety shall pay the difference to the Principal Representative. 2. The Principal Representative may require the Surety on the Contractor ’s bond to take control of the Work and see to it that all the deficiencies of the Contractor are made good, with due diligence within ten (10) days of delivery of Notice to the Surety to do so. As between the Principal Representative and the Surety, the cost of making good such deficiencies shall all be borne by the Surety. If the Surety takes over the Work, either by election upon termination of the services of the Contractor pursuant to Section B(1) of this Article 49, State's Right To Terminate Contract, or upon instructions from the Principal Representative to do so, the provisions of the Contract Documents shall govern the Work to be done by the Surety, the Surety being substituted for the Contractor as to such provisions, including provisions as to payment for the Work, the times of completion and provisions of this Article as to the right of the Principal Representative to do the Work or to take control of all or a portion of the Work. 3. CONDITIONS AND PROCEDURES. (a) A member of the Bargaining Unit must be out of work during the school year due to sickness or injury of the teacher for at least thirty (30) consecutive school days, and s/he must have exhausted his/her own bank of leave days before s/he is eligible to receive any days from the Central Bank. It is understood that the Central Bank Committee may waive part or all of the waiting period if in its judgment, circumstances warrant. (b) Written application (form available in each school office) shall be made to the chairperson of the Central Bank Committee when requesting days from the Central Bank. Such application shall include the following: 1. Date of illness or disability. 2. Date of expiration of the applicant's sick leave days. 3. A statement from a doctor recognized as being appropriate to the treatment of the illness detailing the extent of the disability and indicating the approximate time the member of the Bargaining Unit must refrain from working. (c) A member of the bargaining unit may draw from the Central Bank up to thirty (30) school days at which time another statement from his/her doctor must be presented to the Central Bank Committee re-evaluating the member's health situation and restating an approximate date of return to work. An additional thirty (30) school days may be given upon further evaluation by the Central Bank Committee. This procedure may be repeated if necessary for a final thirty (30) school days. (d) It is understood that while a member is drawing from the Central Bank, s/he is entitled to all fringe benefits as described in the Master Contract. It is further understood that when such member returns to work s/he shall be entitled to the same position s/he occupied prior to the illness or disability, provided that s/he has furnished the Board and Central Bank Committee with medical evidence of his/her fitness to assume his/her former duties. (e) A member who has drawn from the Central Bank and has returned to work shall not be eligible for further benefits from the Central Bank until thirty (30) days have elapsed from the date of his/her return to work. Teachers shall apply for sick leave bank days within ten (10) days after return from sick leave. No consideration will be given any application beyond these ten (10) days. CONDITIONS AND PROCEDURES. The Party seeking indemnification (the “Requesting Party”) shall (a) promptly notify the other Party (the “Indemnifying Party”) in writing upon receipt of oral or written notice of any actual or alleged Claim, (b) allow the Indemnifying Party, at its discretion and cost, to undertake and control the defense of such Claim, (c) diligently assist the Indemnifying Party and cooperate in defending against such Claim; and (d) not, except at its own cost, voluntarily make or agree to make any payment or incur any expense in connection with any such Claim without the prior written consent of the Indemnifying Party. 12.

CONDITIONS AND PROCEDURES. Specific funding for the MSD Enhanced Program is made possible by Reimbursable Funds from MSDE. Program procedures for obtaining these funds are outlined by the MSDE/MSD MOU and are the MSD Enhanced Program Admissions Policy. Aside from IDEA 2004, Part B, statutes or regulations governing funding and provision of services include: The 1964 Civil Rights Act and Amendments, the Code of Federal Regulations (CFR) 34, Education Department General Administrative Regulations (▇▇▇▇▇), General Education Provisions Act (GEPA), Americans with Disabilities Act (ADA), Annotated Code of Maryland, Education Article §8-304; §8-310.1; §8-310.2 COMAR 13A.05.01 and .02; DHMH 10.09.36, .40, .50 and .52, as well as .25 MSD’s Special Education Handbook, 2004 (i.e. PASS) and the MSD Parent-Student Handbook 2004-05 (updated yearly.) MSD is involved with national organizations serving the deaf: Council of American Instructors of the Deaf (CAID), an organization of educators of the deaf in the United States and Canada with the object of “promotion of the education of the deaf on the broadest, most advanced and practical lines,” and for that purpose “to secure the harmonious union in the organization of all persons actually engaged in educating the deaf in America;” and Conference of Educational Administrators of Schools and Programs for the Deaf (CEASD), whose mission is “to promote excellence within a continuum of equitable educational opportunities for all children and adults who are deaf or hard of hearing.” CEASD also advocates “on behalf of individuals who are deaf or hard of hearing and support the efficient, effective management of schools, programs, program service centers, and governmental units offering educational and related programs and services.” ▇▇▇▇▇ ▇. ▇▇▇▇▇▇
CONDITIONS AND PROCEDURES a) Consultation about the potential redundancy situation shall take place over a period of four weeks. b) During this period of consultation and during any subsequent notice period, the Company will assist the employee(s) concerned with retraining/redeployment opportunities, reasonable paid leave of absence to attend interviews for alternative employment and reasonable assistance with the provision of independent financial, personal and career counselling services if required. c) During the consultation period, the Company may also consider offers from any other employee to accept immediate retrenchment in lieu of the potentially redundant employee. Where the Company is satisfied that a substitution can be made having regard for the relative skills and efficiency of the employees concerned, the Company may retrench the substitute employee with appropriate notice and severance payment and the former excess employee redeployed. d) Nothing in this Agreement precludes the employee from agreeing to retrenchment during the consultation period in which case the minimum payment in lieu of notice will be four (4) weeks salary.
