Common use of Conditions and Restrictions Clause in Contracts

Conditions and Restrictions. a) The Account shall be maintained for the exclusive benefit of the Holder, and while there is a holder of the Account, no one other than the Holder and the Trustee shall have any rights relating to the amount and timing of distributions and the investing of funds. This provision shall not apply where such application would be inconsistent with the security contemplated in Section 9. b) No one other than the Holder may make contributions to the Account. c) The Trustee shall not be permitted to borrow money or other property for the purposes of the Account.
