Conduit Occupancy. Occupancy of a Conduit System by any item of Licensee's Facilities.

Conduit Occupancy. Licensee, at its expense, will remove its communications facilities from Conduits or Duct Banks within sixty (60) days after: 21.1.1 Termination of the License covering such Conduit or Duct Bank Occupancy; or 21.1.2 The date Licensee replaces its existing facilities in one Conduit with substitute facilities in another Conduit; or 21.1.3 Licensee’s Facilities are determined to be abandoned by the Licensee; or 21.1.4 WAA determines there is a need for inactive Licensee Facilities to be removed.

Conduit Occupancy. The terms Conduit Occupancy and Occupancy refer to the presence of wire, cable, optical conductors, or other Facilities within any portion of AT&T’s Conduit System.

Conduit Occupancy. The terms “conduit occupancy” and “occupancy” refer to the presence of wire, cable, optical conductors, or other facilities within any portion of BellSouth’s conduit system.

Conduit Occupancy. Licensee, at its expense, will remove its communications facilities from a conduit system within sixty (60) days after: 18.2.1 Termination of the license covering such conduit occupancy; or 18.2.2 The date Licensee replaces its existing facilities in one duct with substitute facilities in another duct. 18.2.3 If Licensee fails to remove its facilities within the specified period, BellSouth shall have the right to remove such facilities at Licensee’s expense and without any liability on the part of BellSouth for damage or injury to such facilities unless caused by the negligence or intentional misconduct of BellSouth.

Conduit Occupancy. MCIm, at its expense, will remove its communications facilities from a conduit system within Attachment VI - 38 MCIm - BellSouth Mississippi Interconnection Agreement sixty (60) days after: 1.16.2.1 Termination of the license covering such conduit occupancy; or 1.16.2.2 The date MCIm replaces its existing facilities in one duct with substitute facilities in another duct.

Conduit Occupancy. Sprint, at its expense, will remove its communications Facilities from a Conduit System within sixty (60) calendar days after: 18.2.1 Termination of the Occupancy Permit covering such Conduit Occupancy; or 18.2.2 The date Sprint replaces its existing Facilities in one Duct with substitute Facilities in another Duct. 18.2.3 In the event that Sprint elected to have unused or abandoned Facilities removed pursuant to section 2.8.4 of this Attachment, Sprint shall not be required to remove its Facilities from such Conduit System as required by section 18.1 to the extent such Sprint Facilities are of a similar quantity and nature to the Facilities removed. In such event, Sprint will be required to tag or otherwise physically identify the Facilities as abandoned or having been removed from service by Sprint.
