Common use of Configuration and Condition Clause in Contracts

Configuration and Condition. The Aircraft shall be returned in the same configuration and condition, ordinary wear and tear from normal airline passenger operations excepted, with all Parts installed therein as on the Delivery Date, excepting only modifications, additions, replacements and substitution of Parts as may have been properly made by Lessee pursuant to Section 5. Lessee shall, prior to such return of the Aircraft furnish Lessor a listing of all such modifications, additions, or replacements made during the Term. Lessee shall provide Lessor with all supporting paperwork, drawings, calculations and approvals associated with all repairs and modifications to the Aircraft. Lessee shall provide Lessor with the last six (6) reliability reports for the Aircraft as provided to the Aviation Authority and a list of all Parts installed on the Aircraft during the last six (6) months of the Term and of all Parts replaced during said last six (6) months. Lessee shall not replace Parts with parts having an operating record indicating a higher failure rate than the Parts replaced.
