Common use of Conflict Between this Agreement and Federal Program Requirements Clause in Contracts

Conflict Between this Agreement and Federal Program Requirements. a. The terms of this Agreement will govern the conduct of the Parties; b. Any direct conflict between the terms of this Agreement and WIC Federal Program requirements stated in 7 C.F.R. § 246, associated WIC Program regulation, policy or the USDA Approved WIC State Plan, will be resolved in favor of the current Federal Program requirement, associated WIC Program regulation, policy or the USDA Approved WIC State Plan for only those parts of this Agreement’s requirements in direct conflict with Federal Program requirements, associated WIC Program regulation, policy or the USDA Approved WIC State Plan. All other provisions will remain unchanged.
