Conflicts in Documentation. This Agreement constitutes the entire understanding between the parties regarding the manufacture of the Products. In case of any conflict between this Agreement and any prior agreements including but not limited to Distribution Agreement or other documents on the same subject, the order of precedence shall be: (1) this Agreement; (2) the schedules; (3) purchase orders; and (4) other documents.
Conflicts in Documentation. In case of any conflicts between this AGREEMENT and any prior agreements on the same subject correspondence, and other documents during the term of this AGREEMENT, this AGREEMENT shall govern and prevail, and the conflicting terms and conditions of any such documents shall be deemed deleted and shall not be binding upon either PARTY. In the event the provisions of this AGREEMENT conflict with provisions of the Appendices, this AGREEMENT shall prevail unless otherwise specifically agreed upon.
Conflicts in Documentation. 2.1 Subject to sub clause 17.5, in the event of any conflict between these Terms and either:
a) the Governing Instrument;
b) any Additional Terms;
c) the Engagement Letter;
d) any relevant Services Agreement;
e) the Application Form;
f) the Terms; the documents shall prevail in the order of (a), (b), (c), (d), (e) and (f).
Conflicts in Documentation. If a conflict arises between this Agreement (other than Article III hereof) and any Appendices or further documentation, this Agreement shall govern and prevail, and the conflicting terms and conditions of any such documents shall be deemed deleted and shall not be binding upon either Party.
Conflicts in Documentation. In the event of a conflict or variation between any provision within the Transaction Documents and the PPM, the Transaction Documents shall take precedence over the PPM.
Conflicts in Documentation. In the event that a conflict arises between this Agreement and any purchase order, separate agreement or schedule implementing this Agreement, the terms of this Agreement shall prevail, unless such purchase order, agreement or Schedule by its terms modifies this Agreement, describes the scope of such modification, and is agreed to in a separate writing by a duly authorized representative of each Party.
Conflicts in Documentation. If there is an express conflict between the provisions contained within the body of this Contract and the provisions of any Exhibit hereto, then the body of this Contractor shall take precedence, except with respect to technical specifications and requirements pertaining to the design, engineering, operation or testing of the Power Plant, with respect to which the conflicting Exhibit shall take precedence.
Conflicts in Documentation. In the event of a conflict in any documentation in this Agreement, the following order of precedence shall govern: (i) subsequent, mutually agreed upon Amendments; (ii) this Agreement; (iii) Appendices; and (iv) purchase orders accepted under this Agreement.
Conflicts in Documentation. This Agreement, including the Exhibits hereto shall be taken as mutually explanatory. If either Party becomes aware of an express conflict between the provisions of this Agreement or any Exhibit hereto, such Party shall promptly Notify the other Party of such conflict. In the event of a conflict between any provision within Articles 1 through 31 of this Agreement and an Exhibit, the provisions of Articles 1 through 31 of this Agreement shall take precedence over Exhibits A and H, which shall in turn take precedence over the remaining Exhibits.
Conflicts in Documentation. In the event of a conflict between the provisions of this agreement and the provisions set forth in the Applicable Catalog Terms, the order of precedence shall be Sections 1-16 of this agreement and then the Applicable Catalog Terms.
