Consequences for Non-Compliance. If the Department has reason to believe that the District is not in substantial compliance with one or more of the statutory or regulatory requirements applicable to the District, the Department shall notify the District that it has ninety (90) days after the date of notice to come into compliance. If, at the end of the ninety-day period, the Department finds the District is not substantially in compliance with the applicable statutory or regulatory requirements, meaning that the District has not yet taken the necessary measures to ensure that it meets the applicable legal requirements as soon as practicable, the District may be subject to the interventions specified in sections ▇▇-▇▇-▇▇▇ through ▇▇-▇▇-▇▇▇, C.R.S. If the District has failed to comply with the provisions of article 44 of title 22 or article 45 of title 22, the District does not remedy the noncompliance within ninety (90) days and loss of accreditation is required to protect the interests of the students and parents of students enrolled in the District public schools, the Department may recommend to the State Board that the State Board remove the District’s accreditation. If the Department determines that the District has substantially failed to meet requirements specified in this accreditation contract and that immediate action is required to protect the interests of the students and parents of students enrolled in the District’s public schools, the Department may lower the District’s accreditation category.
Consequences for Non-Compliance. Failure to comply with the T/E School District High School Student Network Acceptable Use Agreement may result in the loss of a user’s privileges to use District-provided and/or personal electronic resources, disciplinary action up to and including suspension or expulsion from school, depending upon the severity of the offense, and/or referral to the appropriate law enforcement agency where appropriate.
Consequences for Non-Compliance. Sub-Recipient shall ensure that one hundred percent (100%) of the deliverables identified in this contract are performed pursuant to contract requirements. The deliverables described in Section II.D. are identified as major deliverables in this contract. 1. If at any time the Sub-Recipient is notified by the AAAPP that it has failed to correctly, completely, or adequately perform these major deliverables, the Sub-Recipient will have ten (10) days to submit a Corrective Action Plan (CAP) to the AAAPP that addresses the deficiencies and states how the deficiencies will be remedied within a time period approved by the AAAPP. The AAAPP shall assess a Financial Consequence for Non-Compliance on the Sub-Recipient for each deficiency identified in the CAP which is not corrected pursuant to the CAP. The AAAPP will also assess a Financial Consequence for failure to timely submit a CAP. If Sub- Recipient fails to timely submit a CAP, the AAAPP shall deduct 1% of the monthly value of the administrative funds in the contract for each day the CAP is overdue, beginning the 11th day after notification by the AAAPP of the deficiency. The deduction will be made from the payment for the invoice of the followingmonth. 2. In the event that Sub-Recipient fails to correct an identified deficiency within the approved time period specified in the CAP, the AAAPP shall deduct, from the payment for the invoice of the following month, 1% of the monthly value of the administrative funds in the contract for each day the deficiency is not corrected. The AAAPP may also deduct, from the payment for the invoice of the following month, 1% of the monthly value of the administrative funds in the contract for each day the Sub-Recipient fails to timely submit a CAP.

Consequences for Non-Compliance. The misrepresentation of the Contractor in regard of any of the above-mentioned warranties or the involvement of the Contractor in any of these situations described shall constitute the right of PIN to terminate this Contract immediately as in case of a substantial breach of this Contract. In case of such termination PIN shall have the right for reimbursement of damages.
Consequences for Non-Compliance. If Customer is found using water from a hydrant without prior authorization from CCWA, bypassing any backflow preventer or mobile tank air gap, or if Customer otherwise uses water in violation of this Agreement, Customer may be prosecuted and/or required to pay liquidated damages, a past due water fee based on two (2) times the amount of water used, which amount shall be determined by CCWA in its sole discretion. This fee does not constitute a penalty, but an estimate of damages incurred by CCWA because exact damages would be difficult, if not impossible, to determine.

Consequences for Non-Compliance. District staff and the JAC shall monitor the operation of the referral program and the JAC shall consider allegations of non-compliance with the goals stated in this Article 9. If there is a determination by the JAC that a Contractor has not complied with the goals or demonstrated good faith efforts to do so, the issue will be referred to the grievance procedure as provided in Article 12 of this Agreement. 9.17.1 At any time during the process of compliance review, the Contractor can negotiate a settlement with the JAC.
