3.3.1 If any of the conditions specified in Article 3.1.2 is not duly fulfilled by the TSP even within three (3) Months after the time specified therein, then on and from the expiry of such period and until the TSP has satisfied all the conditions specified in Article 3.1.2, the TSP shall, on a monthly basis, be liable to furnish to Central Transmission Utility of India Limited (being the Nodal Agency) additional Contract Performance Guarantee of Rs.8.2crore (Rupees Eight Crore and Twenty Lakh Only) within two (2) Business Days of expiry of every such Month. Such additional Contract Performance Guarantee shall be provided to Central Transmission Utility of India Limited (being the Nodal Agency) in the manner provided in Article 3.1.1 and shall become part of the Contract Performance Guarantee and all the provisions of this Agreement shall be construed accordingly.

Such additional Contract Performance Guarantee shall be provided to Central Transmission Utility of India Limited (being the Nodal Agency) in the manner provided in Article 3.1.1 and shall become part of the Contract Performance Guarantee and all the provisions of this Agreement shall be construed accordingly.
Consequences of non. Performance of Minimum Exploration Work Requirements
(a) require payment of the amount of the minimum expenditure obligation corresponding to the amount of the unfulfilled work activities, to be determined by the Ministry or an independent consultant retained on its behalf at the cost of the Contractor, as fulfilment of the Minimum Exploration Work Requirements for that Period, such payment (including any payment to an independent consultant) not to be a Recoverable Cost;
(b) provided that the Contractor has requested an extension at least thirty (30) Days prior to the expiration of the Period and the reasons stated in the request are accepted by the Ministry, and no extension has previously been granted for that Period, extend the period of time in which the Contractor may carry out the Minimum Exploration Work Requirements for that Period, by up to a maximum of six (6) months; or
(c) terminate this Contract and require payment corresponding to the amount of all unfulfilled work activities under the Minimum Exploration Work Requirements, such payment to be determined by the Ministry or an independent consultant retained on its behalf (such payment including any payment to an independent consultant not to be a Recoverable Cost).
Consequences of non compliance — Suspension of the payment deadline — Termination If the final report submitted does not comply with this Article, the EIT may suspend the payment deadline (see Article 53 FPA) and apply any of the other measures described in Section 5 of the Framework Partnership Agreement. If the KIC LE breaches its obligation to submit the final report and if it fails to comply with this obligation within 30 days following a written reminder sent by the EIT, the Specific Agreement may be terminated (see Article 56 FPA).
Consequences of non compliance If a KIC Partner breaches any of its obligations under this Article, the specific grant may be reduced (see Article 49 FPA). Such breaches may also lead to any of the other measures described in Section 5 of Chapter 3 of the Framework Partnership Agreement.
