CONSTRUCTION AND OCCUPANCY PERMIT APPLICATIONS. Tenant, at Tenant's sole cost and expense, shall apply for all permits required to enable Tenant to commence and complete the construction of Project improvements (the "Construction Permits") and to occupy and operate the Project (the "Occupancy Permits"), and Tenant shall prepare all engineering and construction documents required to apply for or comply with the terms of any Construction Permit. Landlord shall endorse and support Tenant's Permit applications to the extent the same are materially consistent with the approved Plans; provided Landlord shall not be required to incur any out-of- pocket or third-party costs or expenses in connection therewith.
