Consumer Products. ͟ ƐŚĂůů -tŵo-ĞuseĂdŶev iceƌs tĞhaĂt aĚreLJnot Professional Products. Consumer Products shall include, but are not limited to, consumer broadband access and small and home offices (SOHO) markets and the consumer broadcast (televisions, set-top boxes etc.) markets.
Consumer Products. Devices, products, articles or merchandise of common or frequent use, ordinarily bought by individuals or households for private consumption from a retail outlet or otherwise obtained or provided direct to the consumer. (C) SOME STATES OR LOCAL LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU; AND (D) THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE OR LOCATION TO LOCATION.
Consumer Products. This warranty excludes any appliance, piece of equipment, or other item in the Home that is a “Consumer Product” for the purposes of the ▇▇▇▇▇▇▇▇-▇▇▇▇ Warranty Act. All manufacturer warranties on equipment and consumer products (as defined in 15 U.S.C 2301-2312) incorporated into the Home are hereby assigned to Owner. The Company makes no warranties of any kind, express or implied, concerning the equipment or consumer products and expressly disclaims all implied warranties of merchantability, fitness of use for a particular purpose, and other warranties to the fullest extent permitted by state or federal law. The only warranties of such consumer products, such as those items listed below, are those that the manufacturer provides to the Owner. Consumer Products. Jointly Developed Projects for the consumer audience may include NDC's prescription adherence/compliance tool called Care Alert, which the Parties acknowledge will initially target consumers and the prescription refill market. If the Parties mutually agree, Care Alert may also target the physicians market by leveraging other NDC and Medscape tools and services. The Parties further acknowledge that the consumer-based Care Alert product is currently in prototype and is expected to launch in the third quarter of 1999.

Consumer Products. 15.9.1 Where Licensee has: (a) paid for a Product; or (b) received a Product for free as part of a bundle with other paid goods, services or other digital content, and this Product is not generally available to Consumers unless they have paid a price for it or for the other goods, services or other digital content, Sophos warrants that such Products will be (i) of satisfactory quality, (ii) reasonably fit for purpose, and (iii) as described in the Documentation. 15.9.2 Where Sophos is in breach of Clause 15.9.1, Sophos will (i) at its own cost, repair or replace the Product within a reasonable time and without significant inconvenience to the Consumer, or (ii) grant the Consumer a reasonable Fee reduction for the Product where the Product cannot be repaired or replaced within a reasonable time and without significant inconvenience to the Consumer. Licenses for the “Sophos Home Premium” Product may be returned to the Partner from which Licensee purchased the Product for a refund of the Fees paid, for any reason, within thirty (30) days of the date of purchase. 15.9.3 Where the Product Term is perpetual or of an indefinite duration and the Licensee is a Consumer, if Sophos has a right to terminate this License Agreement, Sophos will provide reasonable notice before exercising this right except where there are serious grounds for terminating immediately. 15.9.4 If Licensee is a Consumer in the EU, where a Product supplied to Licensee causes damage to a device or to other digital content which, in either case, is owned by a Consumer (even where such Product is provided for free), Sophos will, in its sole discretion, either (i) at its own cost, repair the damage within a reasonable time and without significant inconvenience to the Consumer, or (ii) compensate the Consumer for the damage with an appropriate payment. 15.9.5 This Clause 15.9 shall take precedence (or in other words, be read so that they replace other terms) to the extent that there are any conflicting terms and conditions elsewhere in this License Agreement.
