Common use of Continued Effect – No Waiver Clause in Contracts

Continued Effect – No Waiver. Notwithstanding any breach of this PPP Agreement by either Party, and without prejudice to any other rights which the other Party may have in relation to it, the other Party may elect to continue to treat this PPP Agreement as being in full force and effect and to enforce its rights under this PPP Agreement. The failure of either Party to exercise any right under this PPP Agreement, including any right to terminate this PPP Agreement and any right to claim damages, shall not be deemed a waiver of such right for any continuing or subsequent breach.
