Common use of Continued Validity Clause in Contracts

Continued Validity. A Holder of Warrant Shares shall continue to be entitled with respect to such shares to all rights and subject to all obligations to which it would have been entitled or subject as Holder under Section 4.5 and Article 8 of this Warrant. The Company will, at the time of each exercise of this Warrant, in whole or in part, upon the request of the Holder of the Warrant Shares issued upon such exercise hereof, acknowledge in writing in form reasonably satisfactory to such Holder, its continuing obligation to afford to such Holder all such rights; PROVIDED, HOWEVER, that if such Holder shall fail to make any such request, such failure shall not affect the continuing obligation of the Company to afford to such Holder all such rights.

A Holder holder of Warrant Shares shall continue to be entitled with respect to such shares Warrant Shares to all rights and subject to all obligations to which it would have been entitled or subject as a Warrant Holder under Section 4.5 and Article 8 Sections 14 through 24 of this WarrantWarrant Agreement.
