Common use of Continuing Right Clause in Contracts

Continuing Right. In no event shall Tenant's failure to exercise its Right of First Refusal to Purchase be deemed a waiver or relinquishment by Tenant of Tenant's Right of First Refusal to Purchase should (i) the space identified in the Notice of Intention to Sell be offered for sale to a potential purchaser other than the purchaser specified in the Notice of Landlord's Intention to Sell during the Term of this Lease or any extension thereof, or (ii) the space identified in the Notice of Landlord's Intention to Sell be offered for sale to any purchaser on terms different than those specified in the Notice of Landlord's Intention to Sell during the Term of this Lease or any extension thereof.
