Common use of Continuing Warranties Clause in Contracts

Continuing Warranties. Borrower’s warranties and representations set forth in Section 5.1 above shall be true and correct at the time of execution of this Agreement and as of the Closing Date, shall survive the closing of the Loan, and shall remain true and correct as of the date on which such warranties and representations are given and shall be true and correct on each date that a Line of Credit Advance is made. For purposes of this Agreement and the other Loan Documents, the term “to the best of ▇▇▇▇▇▇▇▇’s knowledge” shall be deemed to mean to the best knowledge of Borrower after a commercially reasonable and diligent investigation, inspection and inquiry by ▇▇▇▇▇▇▇▇.
