The Continuity of Utilities/Soil Erosion Control Measures clause ensures that essential utility services and soil erosion prevention systems remain operational and effective throughout a construction or development project. In practice, this clause requires contractors to maintain uninterrupted access to water, electricity, and other utilities, as well as to implement and uphold measures such as silt fencing or sediment basins to prevent soil erosion during site work. Continuity of Utilities/Soil Erosion Control Measures. During demolition and construction, the Developer shall coordinate continuity of any and all utilities and services at the site, which utilities shall include but not be limited to electric service, street lighting, sewer, water, gas, and storm drainage, all in recognition of the need for such utilities and services to remain active and usable during this period. Notwithstanding the foregoing, the parties acknowledge that the relocation and rebuilding of ▇▇▇▇▇▇ Avenue and Evergreen Avenue may necessitate temporary disturbances of the utilities, roads, and sidewalks during the course of construction. While this Agreement remains in effect, the Developer shall be responsible for compliance with all federal, state, or local laws, regulations, ordinances, permits, or other authorizations, approvals, or other requirements relating to stormwater discharges or the control of erosion or sediment discharges from the Developer’s performance of the Infrastructure Improvements described herein, including, but not limited to, the Clean Water Act, 33 USC, § 1251, et seq., and the NPDES General Permit for Stormwater Discharges Associated with Construction Activities. The Developer’s construction manager shall be responsible for obtaining all necessary soil erosion control permits and performing all necessary seeding,

  • Safety Measures Awarded vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Awarded vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage.
