Contractor Performance. Work under the Contract shall be performed in a timely, professional and diligent matter by qualified and efficient personnel and in conformity with the strictest quality standards mandated or recommended by all generally-recognized organizations establishing quality standards for the work of the type specified in the Contract. The Contractor shall be solely responsible for controlling the manner and means by which it and its employees or its subcontractors perform the Services, and the Contractor shall observe, abide by, and perform all of its obligations in accordance with all legal and Contract requirements.
Contractor Performance. Contractor has sole control over construction methods, means, techniques, and procedures to perform the SOW in accordance with the terms of this Contract.
Contractor Performance. Monitor the work of the contractor and keep the Owner informed on the progress of the work on a weekly basis, and of any changes required to accomplish the current approved estimates of the project cost or completion dates on a monthly basis, so the Owner will have the appropriate knowledge to make timely changes in the project at its option. Provide sufficient, qualified personnel on-site to monitor that construction is in compliance with the contractors’ contract documents, and according to the schedule and within budget. On the basis of on-site inspections, the CMF shall endeavor to guard the Owner against defects and deficiencies in the work and to achieve satisfactory performance of the work by the contractor. Recommend courses of action to the Owner when contract requirements are not being fulfilled and the non-performing party does not take the corrective action.
Contractor Performance reviews may be undertaken formally or informally. The Contractor will be expected to provide any additional management information required by the Authority to facilitate the reviews and arrange where necessary access to any of its delivery locations, including those operated by Sub-contractors.

Without limiting the foregoing, the Contractor shall control the manner and means of the Services so as to perform the work in a reasonably safe manner and comply fully with all applicable codes, regulations and requirements imposed or enforced by any government agencies. Notwithstanding the foregoing, any stricter standard provided in plans, specifications or other documents incorporated as part of the Contract shall govern. The Contractor shall provide the Services with all due skill, care, and diligence, in accordance with accepted industry practices and legal requirements, and to the Department’s satisfaction; the Department’s decision in that regard shall be final and conclusive. All Contractor’s Services under the Contract shall be performed in material compliance with the applicable federal and state laws and regulations in effect at the time of performance, except when imposition of a newly enacted or revised law or regulation would result in an unconstitutional impairment of the Contract. The Contractor will make commercially reasonable efforts to ensure that Contractor's professional and managerial staff maintain a working knowledge and understanding of all federal and state laws, regulations, and administrative code appropriate for the performance of their respective duties, as well as contemplated changes in such law which affect or may affect the Services delivered under the Contract. The Contractor shall maintain a written contingency plan describing in detail how it will continue operations and Services under the Contract in certain events including, but not limited to, strike and disaster, and shall submit it to the Department upon request.
Contractor Performance. Agencies shall report any vendor failure to perform according to the requirements of this contract on Complaint to Vendor, form PUR 7017. Should the vendor fail to correct the problem within a prescribed period of time, then form PUR 7029, Request for Assistance, is to be filed with this office.
Contractor Performance. OPM will consider such elements as the accurate and timely processing of benefit claims, the volume and validity of complaints received by OPM, effective- ness of internal controls systems in place, the timeliness and adequacy of reports on operations, and responsive- ness to OPM offices, enrollees, bene- ficiaries, and Congress as measures of economical and efficient contract per- formance. Contractor Performance. The Contractor shall manage, integrate, and execute the work described in this PWS. The Contractor shall provide all personnel (trained and qualified), equipment, materials, supplies, and services to complete the Contract work scope, except as furnished by DOE as set forth in the Contract. PWS performance expectations include the following:
1. The Contractor shall provide 100% of all services and deliverables identified in this PWS in a timely, complete, effective, and efficient manner;
2. The Contractor shall ensure that personnel assigned to the Contract have the skills necessary to successfully execute the PWS requirements; and;
3. The Contractor shall meet all security requirements of the NRC License at FSV as well as adhere to and follow all applicable statues, regulations, and DOE Orders which pertain to the activities outlined in the PWS;
4. The Contractor shall ensure that personnel assigned to the Contract have the skills required to perform the PWS requirements; and
5. Contractor personnel shall conduct themselves with professionalism expected in a Government office environment in accordance with applicable DOE and federal regulations. DOE will be measuring the Contractor’s performance for completeness, quality of work, timeliness, and accuracy. Unacceptable work as designated by the Contracting Officer (CO) must be corrected by the Contractor at no additional cost to DOE. Poor performance may result in the DOE not exercising the option under this Contract and/or documenting it in the Contractor Performance Assessment Reporting System (CPARS). Should a fine or penalty be issued by the NRC or DOE resulting from work supporting the NRC license, the DOE will assess the incident, and determine the Contractor or (ICP contractor) liability for the fine or penalty. The Contractor shall be accountable for activities including: compliance with the NRC license and NRC regulations, as well as Environmental Safety and Health (ES&H) and Quality Assurance Program requirements; and DOE-ICP interfaces (e.g., assessments and reviews). The Contractor shall ensure that its technical approach and execution of work are compliant with the applicable statutory and regulatory requirements. The Contractor shall comply with all applicable federal, state, and local requirements and agreements. Contractor Performance. The Contractor shall perform the activities described in the Scope of Work in a proper and satisfactory manner. Unless otherwise provided for in the Scope of Work, any and all equipment, products or materials necessary or appropriate to perform under this Contract shall be supplied by the Contractor. Contractor shall obtain all necessary local, state, and federal authorizations necessary to complete this project, and the Contractor shall be licensed as necessary to perform under this Contract as may be required by law, rule, or regulation; the Contractor shall provide evidence of such compliance to the Commission upon request. The Contractor shall procure all supplies and pay all charges, fees, taxes and incidentals that may be required for the completion of this Contract. By acceptance of this Contract, the Contractor warrants that it has the capability in all respects totally perform the requirements and the integrity and reliability that will assure good-faith performance as a responsible Contractor. Contractor shall immediately notify the Commission’s Contract Manager in writing if its ability to perform under the Contract is compromised in any manner during the term of the Contract. The Commission shall take appropriate action, including potential termination of this Contract pursuant to paragraph twelve (12) Remedies, below, in the event Contractor’s ability to perform under this Contract becomes compromised.
Contractor Performance. A. Contractor shall conduct the activities approved under this award in a manner satisfactory to the Department and consistent with any standards required as a condition of providing these funds. The authorized use of TxCDBG funds is premised upon, and conditioned on, Contractor fulfilling a CDBG national objective as a result of the TxCDBG-assisted activities. Contractor shall perform all activities in accordance with the terms of the Performance Statement (Exhibit A); Budget (Exhibit B); Project Implementation Schedule (Exhibit C); Special Conditions (Exhibit D); Applicable Laws and Regulations (Exhibit E); Certifications (Exhibit F); and with all other terms, provisions, and requirements set forth in this contract. The Application, in addition to any certifications, assurances, information and documentation required to meet award conditions, are hereby incorporated into this contract.
B. Contractor shall ensure that the national program objective identified in the Performance Statement has been met and that the persons expected to benefit from the activities performed under this contract are receiving such benefit before submitting the Project Completion Report to the Department. If Contractor fails to meet a national program objective, Contractor must repay to the Department any associated disallowed costs as specified by the Department.
C. Contractor shall adhere to the Project Implementation Schedule timelines for key project activities. As described in the TxCDBG Project Implementation Manual and policy directives, the Department may require Contractor to submit written justification and take remedial action for any contract activity that is not completed by the date specified on the Project Implementation Schedule.
