Common use of CONTRACTOR’S PROPERTY Clause in Contracts

CONTRACTOR’S PROPERTY. In accordance with Section 3.7 of the Agreement, Contractor shall be responsible for and shall bear the risk of loss and damage to any (i) construction tools and equipment of Contractor (owned or rented) and (ii) any property (other than the Work) for which it is responsible or that is in its care, custody and control, wherever located. Any insurance provided for such construction tools and equipment and such other property shall be at Contractor’s expense and shall otherwise comply with the requirements of this Attachment O. All deductibles with respect to the Contractor’s insurance shall be for the account of Contractor.

CONTRACTOR’S PROPERTY. In accordance with Section 3.7 of the Agreement, Contractor shall be responsible for and shall bear the risk of loss and damage to any property including but not limited to (i) construction tools and equipment of Contractor (owned or rented) and (ii) any property (other than the Work) for which it is responsible or that is in its care, custody and control, wherever located, to the extent that such property is not covered under Owner’s Builder’s Risk insurance. Any insurance provided for such construction tools and equipment and such other property owned or rented by Contractor shall be at Contractor’s expense and shall otherwise comply with the requirements of this Attachment O. expense. All deductibles with respect to the Contractor’s insurance shall be for the account of Contractor.
