Contractual Basis. The Contract - Terms of Reference (Appendix 1) - The Tenderer’s descriptions (Appendix 2) - CSR and Labour Clause (Appendix 3) - Letter of Commitment (Appendix 4) - Solemn Declaration (Appendix 5) In case of conflict between the wording of this Contract and the wording of the Appendices, this Contract takes precedence over the Appendices. The Consultant’s business terms etc. do not apply in the contractual rela- tionship between the Contracting Parties.
Contractual Basis. The Terms, together with the Company’s offer and order confirmation, shall constitute the full contractual basis concerning the Company’s sale and delivery of products, spare parts, and associated services to the customers (hereinafter the “Contractual Basis”). The customer’s terms of purchase, which may be printed on orders or in some other way notified to the Company, shall not be part of the Contractual Basis.
Contractual Basis. 2.1. The FHStG, the accreditation certificate of AQ Austria5 for the respective study programme, and all other relevant laws, such as occupational laws (e.g. the MTD law6 or the GuKG7) including the regulations based on them in particular, form the legal basis of this contract.
2.2. It is agreed that the respective curriculum and the statute (esp. part II, study law) as well as other usage regulations and guidelines (e.g. house rules, library rules, etc.) shall apply to this contract.
2.3. The contractual basis may be subject to changes which become binding for the contractual relationship at hand on the date that they come into force. The Student takes note that the Provider may, with 2 Universities of Applied Sciences Act, Federal Law Gazette (BGBl) I no. 340/1993 as amended 3 in the version BGBl I no. 31/2018
Contractual Basis. The Parties agree that, the financial status of the Company as indicated in the presented documents as of June 30, 2007 (as attached in Annex 3 to this Preliminary Agreement, the“Contractual Basis”) is the basis of the implementation of this Preliminary Agreement.

Terms and conditions printed on orders or in any other way informed by the Customer to the Seller do not constitute to any part of the collected contractual basis. If Customer does not agree to the content of Seller’s order confirmation, the Customer must object within 5 business days after receiving the order confirmation, though no later than by delivery.
Contractual Basis. This Agreement is intended to describe in detail the support services that the Customer has contracted for in the contract entered into between the Supplier and Customer for EMS™ (the “Customer Contract”) and operate alongside the Customer Contract. Should there be a conflict between the terms of this Agreement and the Customer Contract, this Agreement shall take precedence.
Contractual Basis. 2.1 Upon execution of the My Saharogya Marketing Agreement, as provided in Clause 2.2 below, the participant becomes an independent Promoter, free of charge. My Saharogya does not require a Promoter to pay any entry, registration fee or participation fee under the My Saharogya Marketing Agreement.
2.2 The My Saharogya Marketing Agreement will be duly executed, as follows:
(a) Step 1: A participant, desirous of becoming a Promoter, must complete the online registration by filling out and submitting the online registration form.
(b) Step 2: A participant, desirous of becoming a Promoter, must read and accept the Terms of the My Saharogya Marketing Agreement, by clicking on “I have read and accepted the My Saharogya Marketing Agreement and the Code of Ethics” on the My Saharogya Website.
2.3 Upon satisfaction of the above-mentioned requirements, a prospect becomes an independent Promoter, free of charge.
2.4 For the avoidance of doubt, My Saharogya reserves the right, at its sole and absolute discretion, to reject any application for registration as a Promoter.
2.5 My Saharogya grants a cooling-off period to a Promoter, within which he can terminate the My Saharogya Marketing Agreement, should he have a change of mind (“Withdrawal Right”). This Withdrawal Right is available to a Promoter for a period of (30) thirty days (“Withdrawal Period”), from the Commencement Date of the My Saharogya Marketing Agreement. Should a Promoter exercise his Withdrawal Right and give a notice of termina-tion to My Saharogya:
(a) all Benefits, commissions etc. accruing under the My Saharogya Marketing Agreement as per the My Saharogya Income Plan, until the date of termination, will be paid out to the Promoter;
(b) the Promoter may return to My Saharogya any material that he had purchased from My Saharogya. My Saharogya will refund the full price paid for such material, less any reasonable handling charges or consumption charges;
(c) any services purchased by the Promoter from My Saharogya will be cancelled, and the Promoter will be entitled to a refund of any monies paid for such services, less any set-up cost incurred by My Saharogya; and
(d) the Promoter will cease, immediately and without further notice, to be a Promoter.
2.6 The contract between the Parties comprises the My Saharogya Marketing Agreement and any amendments thereto, the My Saharogya Income Plan and the Code of Ethics for My Saharogya Promoters and any additional My Saharogya Marketing Agreement (provided in C...
Contractual Basis. The Supplier shall: • deliver the range of Services as detailed in sections 4 to 16 below; • be responsible for planning, coordinating and delivering all requirements of this Contract for the Prices detailed in Schedule C; • mobilise and implement the Services by the Go Live Date and meet all timescales set out in this Schedule B; and • comply with all relevant legislation and regulatory provisions when delivering the Services.
Contractual Basis. The insurance contract consists of the Policy Schedule and these insurance Terms and Conditions. The laws and jurisdiction of Denmark apply to this insurance contract.
Contractual Basis. 1.01 Upon acceptance by Supplier, the binding agreement between RÖCHLING and Supplier is evidenced by the “Master Agreement.” All the documents listed in the Master Agreement and these Terms and Conditions constitute an integral part of the contract between RÖCHLING and Supplier. The Parties are agreed that the contractual and other specified provisions shall apply in the following order with the proviso that, in the event of any inconsistencies or gaps, the document positioned higher in the list shall take precedence:
