Common use of Contractual Relationship Clause in Contracts

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case each Authorized Affiliate agrees to be bound by the Customer’s obligations under this DPA, if and to the extent that Customer Processes Personal Data on the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”. All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. All access to and use of the Services Service by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer.

All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicablemay be the case, in the name and on behalf of its Authorized Affiliates, in which case thereby establishing a separate DPA between ▇▇▇▇▇▇▇ and each such Authorized Affiliate. Each Authorized Affiliate agrees to be is bound by the Customer’s obligations under this DPA. For the avoidance of doubt, if an Authorized Affiliate is not and does not become a party to the extent that Customer Processes Personal Data on Agreement, but is only a party to the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”DPA. All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The Parties parties acknowledge and agree that, by executing the DPAAgreement, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case thereby establishing a separate DPA between SmartSimple and each such Authorized Affiliate subject to the provisions of the Agreement and this Section 9 and Section 10. Each Authorized Affiliate agrees to be bound by the Customer’s obligations under this DPADPA and, if and to the extent that Customer Processes Personal Data on applicable, the behalf of such Authorized AffiliatesAgreement, thus qualifying them as and is only a party to the “Controller”DPA. All access to and use of the Services and Content by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA Agreement, and any violation of the terms and conditions therein of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

Each Authorized Affiliate agrees to be bound by the Customer’s obligations under this DPADPA and, if and to the extent that Customer Processes Personal Data on applicable, the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”Agreement. All access to and use of the Services and Content by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case each Authorized Affiliate agrees shall be deemed to have agreed to be bound by the Customer’s obligations under this DPA, if and to the extent that Customer accessiBe Processes Personal Data on the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”. All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA DPA, and the Customer shall procure that each Authorized Affiliate so complies, and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The Parties acknowledge and agree that, by executing entering into the DPAAgreement with RouteSmart, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case each Authorized Affiliate agrees to be bound by the Customer’s 's obligations under this DPA, if and to the extent that Customer Processes Personal Data on the behalf of such Authorized Affiliates, thus qualifying them as the “"Controller”". All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case each Authorized Affiliate agrees to be bound by the Customer’s obligations under this DPA, if and to the extent that Customer Processes Personal Data on the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”. All access to and use of the Services Service by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer. Communication. Customer shall remain responsible for coordinating all communication with Processor under the Agreement and this DPA and shall be entitled to make and receive any communication in relation to this DPA on behalf of its Authorized Affiliates.

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case each Authorized Affiliate agrees to be bound by the Customer’s obligations under this DPA, if and to the extent that Customer Riverside Processes Personal Data on the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”. All access to and use of the Services Platform by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, in which case each Authorized Affiliate agrees to be bound by the Customer’s obligations under this DPA, if and to the extent that Customer Hunters Processes Personal Data on the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”. All access to and use of the Services Service by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein by an Authorized Affiliate shall be deemed a violation by the Customer.

Contractual Relationship. The Parties acknowledge and agree that, by executing the DPA, the Customer enters into the DPA on behalf of itself and, as applicablemay be the case, in the name and on behalf of its Authorized Affiliates, in which case thereby establishing a separate DPA between Trimble and each such Authorized Affiliate. Each Authorized Affiliate agrees to be is bound by the Customer’s obligations under this DPA. For the avoidance of doubt, if an Authorized Affiliate is not and does not become a party to the extent that Customer Processes Personal Data on Agreement, but is only a party to the behalf of such Authorized Affiliates, thus qualifying them as the “Controller”DPA. All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement and this DPA and any violation of the terms and conditions therein of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.
