Control/Application of the DPA. In the event of any conflict or discrepancy between the SCCs, the Terms of Use, the terms and conditions of this DPA, and any Agreement, the following order of precedence will apply: (a) the SCCs (where applicable), (b) this DPA, (c) any Agreement; and (d) the Terms of Use. This DPA applies only to Customer, and Matterport and does not confer any rights to any third party hereunder.
