Control of Suit Clause Samples

The Control of Suit clause defines which party has the authority to direct and manage any legal proceedings related to a claim covered by the contract, such as lawsuits or settlements. Typically, this clause specifies whether the insurer or the insured will take charge of defending or settling claims, and may outline procedures for cooperation and consent. Its core practical function is to clarify decision-making power in litigation, thereby preventing disputes over who controls the defense and ensuring efficient handling of legal matters.
