Common use of Cooperation of the Trustee Clause in Contracts

Cooperation of the Trustee. The Trustee shall cooperate fully with the City, at the expense of the City or in accordance with Section 10.03 of the Indenture, in filing any proof of loss with respect to any insurance policy or performance bond covering the events described in Section 11.1 of this Lease and in the prosecution or defense of any prospective or pending condemnation proceeding with respect to the Leased Property and in the enforcement of all warranties relating to the Leased Property. So long as no Event of Lease Default or Event of Non-appropriation has occurred and is then existing, the Trustee shall not voluntarily settle, or consent to the settlement of, any proceeding arising out of any insurance claim performance or payment bond claim, prospective or pending condemnation proceeding with respect to the Leased Property without the written consent of the City.
