Common use of Cooperative Contract Clause in Contracts

Cooperative Contract. (a) The Authority has entered into a master cooperative purchasing agreement with other governmental entities (with the Authority, the “Cooperative Members”) to form the Texas Interlocal Purchase Purchasing Cooperative, under which the Cooperative Members grant access and make available to one another certain contracts of the Cooperative Members, pursuant to the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code and Chapter 271 of the Texas Local Government Code. The Contractor agrees to offer to other eligible Cooperative Members the goods and services provided under this Contract with the same prices, and under terms and conditions, of this Con- tract.’ (b) The Authority does not accept any responsibility or liability arising from or related to a separate contract be- tween another Cooperative Member and Contractor based on this Contract or for any purchases made thereunder. (c) Cooperative Members shall not create participating cooperative contracts to procure professional services as defined by Texas Government Code Chapter 2254.
