Common use of Corporate Name; Prior Transactions Clause in Contracts

Corporate Name; Prior Transactions. Except as set forth on Schedule 6.4, no Obligor has, during the five (5) years prior to the Closing Date, been known by or used any other corporate or fictitious name, or been a party to any merger or consolidation, or acquired all or substantially all of the assets of any Person, or acquired any of its property outside of the ordinary course of business.

Except As of the Agreement Date, except as set forth on Schedule 6.47.4, no Obligor has, during the five (5) years prior to the Closing Agreement Date, been known by or used any other corporate or fictitious name, or been a party to any merger or consolidation, or acquired all or substantially all of the assets of any Person, or acquired any material portion of its property outside of the ordinary course of its business.

Except as set forth on Schedule 6.4, no Obligor has, None of the Obligors has during the five (5) years prior to preceding the Closing Date, Date been known by or used any other corporate or fictitious business name, or been a party to any amalgamation, merger or consolidation, or acquired all or substantially all of the assets of any Person, Person or acquired any of its property outside or their Property out of the ordinary course of business., except as set forth on Exhibit E.
