Common use of Corrupt or Fraudulent Practices Clause in Contracts

Corrupt or Fraudulent Practices. The Contractor and it’s agents (whether declared or not), sub-contractors, sub- consultants, service providers or suppliers, and any personnel thereof, shall not engage in corrupt, fraudulent, collusive or coercive practices, in competing for or in executing the Contract. If the Authority determines, based on reasonable evidence, that the Contractor has engaged in corrupt, fraudulent, collusive or coercive practices, in competing for or in executing the Contract, then the Authority may, after giving 14 days’ notice to the Contractor, terminate the Contract and expel him from the Site, and the provisions of Clause 23 shall apply as if such termination had been made under Clause 23.1 [Termination for Contractor Defaults]. Should any employee of the Contractor be determined, based on reasonable evidence, to have engaged in corrupt, fraudulent or coercive practice during the execution of the work then that employee shall be removed in accordance with Clause 3.4 [Contractor’s Personnel].
