Common use of Cost Liability Clause in Contracts

Cost Liability. Neither the Governor of Virginia nor the VCCS assumes liability by virtue of this Agreement for any costs incurred above the amounts provided pursuant to this Agreement or for costs incurred by the LWDB or its one-stop operators or contractors that are determined to be unallowable. Any such costs shall be at the sole risk of the LWDB or its contractors. The foregoing provisions of this Paragraph are not intended to preclude and shall not be deemed to preclude the LWDA or its contractors from asserting any defense that may be asserted hereafter.
