Common use of Current State Clause in Contracts

Current State. The Land is sold: (a) in its current state of repair and condition and with any defects (including defects in design, construction or repair) as at the date of this Agreement; and (b) subject to any deterioration as a result of fair, wear and tear from the date of this Agreement until the Date of Completion.
