Common use of Curricular Needs Clause in Contracts

Curricular Needs. a. Peer-reviewed research and evidence-based programs and other professional credentials in relation to program need and the identification of involuntary transfers. Because the District has an interest in having a special education teacher/provider at each site trained in peer-reviewed research and evidence-based programs, the Federation and the District agree: If there is a reduction in the special education teaching staff at a school, and the employee who is trained in evidence-based programs is the least senior person, then the case will be brought to a panel made up of one ATF person and one APS person. The APS/ATF Panel will consider the needs of the school’s special education students and the background and qualifications of the special education staff in peer-reviewed research and evidence-based programs. In the event the District believes that a teacher’s credential or level of training constitutes a program need not identified in Article 16. B. 7. of this Agreement, the case will be addressed as in a.1 and a.2 above.
