Common use of Customer First Clause in Contracts

Customer First. During the period that Continental places its designator code on flights operated by Contractor, Contractor will adopt and follow plans and policies comparable (to the extent applicable and permitted by law and subject to operational constraints) to Continental's Customer First Commitments as presently existing and hereafter modified. Contractor acknowledges that it has received a copy of Continental's presently existing Customer First Commitments. Continental will provide Contractor with any modifications thereto promptly after they are made. Continental will support participation by Contractor and its employees in the Zed Associate Membership travel program. THIS FUEL PURCHASING AGREEMENT (this “Agreement”) is made as of the 1st day of May, 2012, by and between CONTINENTAL AIRLINES, INC., a Delaware corporation (“Continental”), and Republic Airline Inc. an Indiana corporation (“Contractor”).
