Customer Terms of Use. Reseller shall resell the Aviatrix Offerings only to the authorized Customer specified above. The software component of the Aviatrix Offerings is licensed directly to each Customer and not sold. Reseller shall reference Aviatrix’s Customer Terms of Use located at ▇▇▇▇▇▇▇▇.▇▇▇ on its order form or agreement with Customer and require Customer to agree to such terms with Aviatrix, unless Aviatrix has confirmed in writing to Reseller that it has active Terms of Use for the Aviatrix Offerings directly with Customer. For Orders processed through CPPO, the Customer Terms of Use are referenced as a component of the offer using standard AWS CPPO processes. Aviatrix’s obligations with respect to consulting services resold hereunder shall be direct with Customer pursuant to the Customer Terms of Use and not as a subcontractor to Reseller.

Customer Terms of Use. Partner may not provide the Customer with the Product(s), or permit the Customer to access or use the Product(s), except in accordance with the Customer Terms of Use. Partner shall ensure that its contract with the Customer requires the Customer to agree to and be bound by the Customer Terms of Use. Customer Terms of Use. Tribal has provided Content Partner with a Customer Terms of Services Agreement (“Customer TOS”) as of the date hereof, attached hereto as Exhibit A, applicable to Tribal customers of the Services (“Customers”) and Customer’s Authorized Users. Content Partner acknowledges that the Customer TOS is in form and substance acceptable to Content Partner. Tribal agrees to provide Content Partner with any additional terms and conditions of use, different or additional to the Customer TOS, that Tribal plans to distribute or publish with the Services and that will be applicable to the Licensed Content (“TOU”) prior to the TOU’s distribution or publication.
