Common use of Damage to Project Clause in Contracts

Damage to Project. If, at any time during the Term, the Project is substantially damaged or destroyed and rendered inoperable by fire or other occurrence of any kind, Authorized Sublessee must, at its sole cost and expense either (a) repair or replace the Project, or (b) elect to terminate this Sublease Agreement, in which case Authorized Sublessee must Decommission the Project, as required by this Sublease and in accordance with any other agreements between Primary Tenant and Authorized Sublessee.
