DAMAGE TO THE PROPERTY. The ZOO agrees to repair and/or replace any damage to any portion of the Property as a result of its use pursuant to this Agreement. All costs for such repair or replacement, and all work performed, shall be the responsibility of the ZOO. The City Engineer shall have the sole discretion to determine when the Property is in need of repair or replacement. Upon termination of this Agreement, the ZOO shall restore the Property to its original condition.
