Common use of Dark Fiber Loops Clause in Contracts

Dark Fiber Loops. Except as otherwise provided in this section, Verizon shall provide ***CLEC Acronym TXT*** with nondiscriminatory access to a dark fiber loop on an unbundled basis. Subject to the provisions of Section 3.9, Verizon shall be relieved of its obligation under Section 251(c)(3) of the Act to provide ***CLEC Acronym TXT*** with access to Dark Fiber Loops under the Amended Agreement at a specific customer location upon a finding in a final and non-appealable order by the [***State Commission TXT***] or the FCC that requesting telecommunications carriers are not impaired without access to such Loops at such customer location.
