Common use of Data Practices Act Compliance Clause in Contracts

Data Practices Act Compliance. Any and all data provided to Contractor, received from Contractor, created, collected, received, stored, used, maintained, or disseminated by Contractor pursuant to this Agreement shall be administered in accordance with, and is subject to the requirements of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13. Contractor agrees to notify the City within three business days if it receives a data request from a third party. This paragraph does not create a duty on the part of Contractor to provide access to public data to the public if the public data are available from the City, except as required by the terms of this Agreement. These obligations shall survive the termination or completion of this Agreement.

Any and all data provided to ContractorConsultant, received from ContractorConsultant, created, collected, received, stored, used, maintained, or disseminated by Contractor Consultant pursuant to this Agreement shall be administered in accordance with, and is subject to the requirements of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13. Contractor Consultant agrees to notify the City within three business days if it receives a data request from a third party. This paragraph does not create a duty on the part of Contractor Consultant to provide access to public data to the public if the public data are available from the City, except as required by the terms of this Agreement.
