Common use of Data Subject Requests Clause in Contracts

Data Subject Requests. To the extent legally permitted and required, Vendor shall promptly notify Epicor if Vendor receives a request from a Data Subject to exercise the Data Subject’s right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, objection to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Factoring into account the nature of the Processing, Vendor shall assist Epicor by appropriate organizational and technical measures, insofar as this is possible, for the fulfilment of Epicor’s obligation to respond to a Data Subject Request under Applicable Data Protection Laws and Regulations and its agreements with its customers. In addition, to the extent Epicor, in its use of the Service, does not have the ability to address a Data Subject Request, Vendor shall, upon Epicor’s request, provide commercially reasonable efforts to assist Epicor in responding to such Data Subject Request, to the extent that Vendor is legally authorized to do so, and the response to such Data Subject Request is required under Applicable Data Protection Laws and Regulations and Epicor’s agreements with its customers.

Data Subject Requests. Factoring into account the nature of the Processing, Vendor Epicor shall assist Epicor Customer by appropriate organizational and technical measures, insofar as this is possible, for the fulfilment of EpicorCustomer’s obligation to respond to a Data Subject Request under Applicable Data Protection Laws and Regulations and its agreements with its customersRegulations. In addition, to the extent EpicorCustomer, in its use of the ServiceServices, does not have the ability to address a Data Subject Request, Vendor Epicor shall, upon EpicorCustomer’s request, provide commercially reasonable efforts to assist Epicor Customer in responding to such Data Subject Request, to the extent that Vendor Epicor is legally authorized to do so, and the response to such Data Subject Request is required under Applicable Data Protection Laws and Regulations and Regulations. To the extent legally permitted, Customer shall be responsible for any reasonable costs arising from Epicor’s agreements with its customersprovision of such assistance.
