Common use of Deadline to Opt-Out Clause in Contracts

Deadline to Opt-Out. To be excluded from the Settlement, the Opt- Out Form or any written request to opt-out must be completed by the Objection and Exclusion Deadline. (i) If submitted electronically, the Opt-Out Form or any written request to opt-out must be submitted no later than 11:59 p.m. PST on or before the Objection and Exclusion Deadline. (ii) If submitted by U.S. mail, the Opt-Out Form or any written request to opt-out must be postmarked no later than the Objection and Exclusion Deadline. The date of the postmark on the envelope containing the written request to opt-out shall be the exclusive means used to determine whether an request to opt-out has been timely submitted. In the event a postmark is illegible, the date of mailing shall be deemed to be three (3) days prior to the date that the Settlement Administrator received a copy of the request to opt- out of the Settlement. The Settlement Class Member must pay for Postage.
