Common use of Decisions of Arbitrators Clause in Contracts

Decisions of Arbitrators. (1) of the essence. The arbitrator(s) shall proceed promptly to hear and determine the Dispute. Time shall be (2) Notwithstanding Rule 36 of the National Arbitration Rules, the arbitrator(s) shall not be entitled to retain their own expert(s). (3) The decision of the arbitrator(s) shall constitute the award of the arbitration. The award shall be final and binding upon the Parties as to any matter or matters so submitted to arbitration and the Parties shall comply with the terms and conditions of the determination of the arbitrator or arbitrators. For greater clarity, there shall be no appeal from the award on any question of fact, law or mixed fact and law.
