Common use of Declaration of Redundancy Clause in Contracts

Declaration of Redundancy. a) Where staffing reductions may be necessary due to redundancy, the Director of Education or designate shall meet with the Association or its representative(s) to inform them of the situation. b) When reduction of teaching staff is effected, reduction will be applied in the following order: (i) normal attrition (ii) seniority (iii) system curriculum needs c) Where a Teacher may be declared redundant due to lack of special qualifications needed to meet system curriculum needs, the Board shall retain such Teacher where the Teacher makes a commitment to become qualified prior to the commencement of the assignment. The Teacher shall reimburse the Board for 100% of the premiums on a monthly basis in advance by means of automatic bank withdrawals. e) A Teacher declared redundant in the secondary panel shall be offered a position in an elementary panel vacancy, which the Board intends to fill, if the Teacher holds the necessary qualifications including any required special qualifications. A teacher in this situation shall maintain his/her right of recall to the secondary panel. f) The Board shall provide a list of redundant Teachers, stating school location and seniority, to the LTBU.

A Teacher may be declared redundant due refuse to lack exercise his or her right of special qualifications needed to meet system curriculum needs, the Board shall retain such Teacher where the Teacher makes a commitment to become qualified prior to the commencement of the assignmentrecall two (2) times only. A teacher in this situation shall maintain his/her right of recall to the secondary panelis qualified. f) The A Teacher who is declared redundant shall be placed on the Occasional Teachers List and given priority placement. g) Teachers shall be withdrawn from the recall list should they accept a teaching contract with another employer. h) Teachers who have not been recalled to employment with the Board in accordance with paragraph (d) above within four (4) years of their release shall provide lose all rights to recall, as per Section 12 of Part A of this Collective Agreement. i) Prior to any external hires and provided that there are no redundant Secondary Teachers covered by this Collective Agreement remaining to be recalled, the Board will offer any vacant Secondary teaching positions to any qualified Elementary Teachers who have been declared redundant and are awaiting recall. In order to support cross panel placements, the Board and the Unit agree to a list of redundant Teachers, stating school location and seniority, to the LTBUone-year mentorship program.
