Common use of Deemed Acceptance Clause in Contracts

Deemed Acceptance. Each Related Party of Buyer, the Seller, HEI or SALN, as the case may be, seeking the benefit of Article VIII of this Agreement shall be deemed to have accepted and agreed to the provisions of this Section 9.4 as a condition to obtaining any benefits under Article VIII as if such Person was one of the Parties named herein.
