Common use of Default by a Party Clause in Contracts

Default by a Party. If there occurs an Event of Default with respect to a party, the other party may: (a) seek damages; and/or (b) seek an injunction or an order for mandatory or specific performance; and/or (c) terminate this Agreement and the licenses granted to LICENSEE hereunder whereupon the non-defaulting party shall have no further obligations under this Agreement except those which expressly survive termination, and except with respect to royalty payments due and owing to LICENSOR as of the termination date or any subsequent period specified in Section 10.4.
